How does an eviction work?

A landlord can't evict you without a court order from a state district court. For some reasons, like not paying rent three days after it is due, the landlord first serves a 3 day notice. A summons and complaint starts the court case. Gather your papers, go to the hearing, and ask for more time if you need it. The court says to talk to a lawyer as soon as you get a notice or summons.

How fast is it?

The Attorney General says the landlord serves a notice to quit with 3 days to leave. If you stay, a court summons and complaint follow, with a hearing set 3 to 15 days later.

What about my deposit and rent increases?

Your deposit and an itemized list of any deductions are due back within 30 days after you move out. On a month to month lease, the landlord must give written notice at least 30 days before a rent increase. Housing discrimination complaints go to the North Dakota Department of Labor. For consumer questions, call the Attorney General at 701 328 3404 or 800 472 2600.

Can the court help me fill out forms?

The Legal Self Help Center gives general information on civil court steps, with guides and forms. It can't give legal advice or act as your lawyer. Call 701 328 1852. Its forms aren't official court forms, and courts aren't required to accept them.
