Legal and tenant help in Idaho

The short answer

In Idaho, a landlord must give you 3 days' written notice (not counting weekends and holidays) before evicting for unpaid rent. Pay all the back rent in those 3 days and you can't be evicted for it. Eviction cases for unpaid rent can move to trial in 5 to 12 days, so get help right away.

What the Idaho courts say

  • For unpaid rent, the landlord must give 3 days' written notice. Weekends and holidays don't count. If you pay the back rent within those 3 days, you can't be evicted (Idaho Code 6 303).
  • For unpaid rent, the landlord can ask for a fast trial, 5 to 12 days after you get notice of the court case.
  • In a regular eviction (other lease problems), you have 20 days to file an Answer.
  • Talk to a lawyer right away if you get a Summons and Complaint.
Bunkly tip. Don't ignore the papers. Write down the date you got them, and call for help the same day.
